Welcome to Lukiko.com, a multivendor online marketplace operating in accordance with the laws of the United Republic of Tanzania. These General Terms & Conditions (“Terms”) govern your access to and use of the Lukiko.com website, mobile platforms, and related services.

By accessing or using Lukiko.com, you confirm that you have read, understood, and agreed to these Terms.

1. Legal Framework

These Terms are established in compliance with:

1. The Electronic Transactions Act, No. 13 of 2015
2. The Cybercrimes Act, No. 14 of 2015
3. The Fair Competition Act
4. Applicable consumer protection and commercial laws of Tanzania

2. Definitions

1. “Platform” means the Lukiko.com website and related systems.
2. “User” means any person accessing or using the Platform.
3. “Customer” means a User who purchases goods.
4. “Vendor” means a registered seller offering products on the Platform.
5. “Lukiko.com,” “we,” “us” refers to Lukiko Marketplace.

3. Eligibility & Capacity

1. Users must be 18 years or older to create an account or transact.
2. By using the Platform, you confirm you have legal capacity to enter binding contracts under Tanzanian law.

4. Account Registration & Security

1. Users must provide accurate, current, and complete information.
2. You are responsible for safeguarding your login credentials.
3. Any activity performed through your account is deemed to be authorized by you.

Lukiko.com may suspend or terminate accounts suspected of fraud, misuse, or violation of Tanzanian laws.

5. Nature of the Marketplace

Lukiko.com operates as an intermediary marketplace connecting Vendors and Customers.

1. Lukiko.com does not manufacture, own, or directly sell vendor-listed products.
2. Contracts for sale are formed directly between the Vendor and the Customer, in accordance with the Electronic Transactions Act, 2015.

6. Vendor Obligations (Legal Compliance)

Vendors agree to:

1. Sell products that comply with Tanzania laws and standards
2. Provide truthful descriptions, pricing, and images
3. Fulfill orders within agreed timelines
4. Respect consumer rights, including refunds and returns where applicable
5. Avoid selling prohibited, counterfeit, or illegal goods

Lukiko.com reserves the right to remove listings or suspend vendors violating these obligations.

7. Orders, Pricing & Payments

1. All prices must be clearly displayed and transparent.
2. Payments are processed through secure, compliant third-party payment providers.
3. Vendors may be charged a commission or service fee per completed transaction.

Electronic payment records are legally recognized under the Electronic Transactions Act, 2015.

8. Shipping & Delivery

1. Vendors are responsible for packaging and shipping products.
2. Delivery timelines depend on customer location and logistics providers.
3. Lukiko.com is not liable for courier delays beyond reasonable control.

9. Returns, Refunds & Cancellations

Customers are entitled to fair treatment under Tanzania consumer protection principles.

All returns, refunds, and cancellations are governed by Lukiko.com’s:

These policies form part of these Terms.

10. Consumer Rights

Customers have the right to:

1. Accurate product information
2. Fair pricing
3. Safe and lawful products
4. Refunds or replacements for defective or misrepresented goods

Lukiko.com supports dispute resolution between Vendors and Customers in line with Tanzanian law.

11. Prohibited Conduct

Users must not:

1. Engage in fraud, deception, or misrepresentation
2. Upload illegal, harmful, or misleading content
3. Violate the Cybercrimes Act, 2015
4. Interfere with platform security or data integrity

Violations may lead to account termination and legal action.

12. Reviews & User Content

1. Reviews must be honest and lawful.
2. Lukiko.com may remove content that is defamatory, false, or abusive.
3. User content must comply with Tanzanian laws and public order standards.

13. Intellectual Property

All platform content, branding, and software are protected under Tanzanian intellectual property laws.

Unauthorized reproduction or use is strictly prohibited.

14. Data Protection & Privacy

Lukiko.com processes personal data in accordance with:

1. Tanzanian data protection principles

Users consent to lawful collection and processing of personal data for platform operations.

15. Limitation of Liability

To the extent permitted by Tanzanian law:

2. Lukiko.com is not responsible for indirect or consequential losses
3. Liability is limited to platform service provision only

16. Indemnification

Users agree to indemnify Lukiko.com against losses, claims, or damages arising from:

1. Breach of these Terms
2. Violation of Tanzanian law
3. Misuse of the Platform

17. Suspension & Termination

Lukiko.com may suspend or terminate access:

1. For breach of these Terms
2. For illegal activity
3. To comply with lawful government or regulatory requests

18. Governing Law & Jurisdiction

These Terms are governed by the laws of the United Republic of Tanzania.

Any disputes shall be resolved under Tanzanian courts or recognized dispute resolution mechanisms.
